These Terms and Conditions (“Terms”) govern the use of services provided by The HALO Firm, LLC (“Company,” “we,” “our,” “us”). By engaging with our concierge care, wellness, case management, or DNA diagnostic services, you (“Client,” “you,” “your”) agree to these Terms.
1. DEFINITIONS
1.1 Company: The HALO Firm, LLC.
1.2 Client: A private individual, business, or entity ordering a Service.
1.3 Nominated Person: The person designated to receive results or reports.
1.4 Sampler: The person who collects biological or clinical samples.
1.5 Service: Any concierge care, wellness screening, case management, employer health program, or DNA/genetic test offered by the Company.
1.6 Order for Services: Any request for Services, whether made in person, by phone, email, online form, or other method.
1.7 Price: The current listed price for the Company’s Services.
1.8 Kit: The sample collection kit provided to the Client for DNA or related testing.
2. APPLICATION OF TERMS
2.1 These Terms apply exclusively and override any other terms proposed by the Client.
2.2 All Orders are considered offers to purchase. Payment in full constitutes acceptance of these Terms.
3. SCOPE OF AGREEMENT
3.1 No additional conditions apply unless agreed to in writing by the Company.
3.2 These Terms do not affect statutory consumer rights.
3.3 If any provision is deemed unenforceable, the remaining provisions remain in force.
3.4 Where multiple persons are the Client, obligations are joint and several.
4. CONCIERGE CARE & WELLNESS SERVICES
4.1 Scope: The HALO Firm provides private concierge care, including CLIA-waived screenings (e.g., glucose, cholesterol, HbA1c, flu, strep, pregnancy), vitals checks, biometric testing, DNA-based wellness kits, case management, navigation support, and workplace health programs.
4.2 Non-Medical Disclaimer: Our services are not a substitute for emergency medical care or treatment by a licensed physician. Clients are responsible for seeking medical attention when appropriate.
4.3 Case Management: Guidance, scheduling, and advocacy are provided to assist Clients in coordinating care. The Company is not responsible for third-party provider performance or outcomes.
4.4 Wellness Screenings: Screenings are informational tools only and should not be relied upon as definitive medical diagnoses. Clients are encouraged to follow up with a healthcare professional.
4.5 Limitations: Services do not include home health agency care, Medicaid/Medicare billing, or Home and Community Based Services (HCBS).
5. PURPOSE OF DNA & GENETIC TESTING
5.1 DNA and genetic tests provide insights into traits, predispositions, or conditions based on the selected test type.
5.2 Results are for informational and educational purposes only and are not medical advice.
5.3 Clients are encouraged to consult a physician or genetic counselor before and after testing.
5.4 Results are estimates only. Environmental, lifestyle, and other non-genetic factors also affect health outcomes.
5.5 Genetic information is permanent and may have personal or emotional impacts.
6. USE OF SPECIMENS (DNA TESTING ONLY)
6.1 After testing, samples may be destroyed or retained for quality assurance or research unless the Client declines.
6.2 Clients may withdraw consent for research use at any time without affecting their results.
7. COMPANY RESPONSIBILITIES
Qualified Providers: Screenings and testing are conducted by trained staff or accredited laboratories (ISO 17025 or equivalent, where applicable).
Turnaround Times: Service timelines begin once samples or required information are received. Timelines are estimates only.
Kits & Supplies: Kits are shipped via standard carriers unless otherwise arranged. Damaged Kits will be replaced if promptly reported.
Accuracy: While testing and screenings are conducted using validated methods, no test or screening is 100% accurate. Liability is limited to the cost of the Service.
Refusals: The Company reserves the right to refuse service if samples are obtained illegally, or if the requested use is improper.
Reports: Results are sent to the Nominated Person unless otherwise agreed.
8. CLIENT RESPONSIBILITIES
Provide accurate and complete personal, medical, and payment information.
Follow all instructions for screenings, testing, and case management.
Ensure legal rights to submit any biological samples.
Use services only for lawful, intended purposes.
Indemnify the Company against claims related to misuse of services or submission of unauthorized samples.
Maintain confidentiality of reports unless disclosure is authorized.
9. FEES & PAYMENT
Prices are listed on our website or available upon request.
Full payment is required prior to service.
Payments must be made in full, free of transaction fees.
For DNA testing, samples must be submitted within three (3) months of ordering; late submissions may incur reactivation fees.
10. CANCELLATION & REFUNDS
Concierge services cancelled with at least 24 hours’ notice may be rescheduled without penalty.
A full refund is available for DNA testing if cancelled before a Kit is issued.
If cancelled after Kit issuance but before sample return, a postage/administration fee applies.
No refunds are provided once samples are received for testing or once a service has been performed.
11. TIMEFRAMES
Estimated service and result timelines are for guidance only. The Company is not responsible for delays caused by laboratories, carriers, third-party providers, or circumstances beyond our control.
12. COPYRIGHT & INTELLECTUAL PROPERTY
All materials, reports, guides, and documentation remain the property of the Company and may not be copied, distributed, or reproduced without prior written consent.
13. DATA PROTECTION & PRIVACY
13.1 Personal and health data are processed in compliance with HIPAA (where applicable), Louisiana law, and other relevant privacy regulations.
13.2 Information is used solely to deliver Services, manage accounts, and comply with legal obligations.
13.3 Data may be shared with laboratories, logistics providers, or healthcare partners only as necessary to fulfill an order or requested service.
13.4 DNA samples may be retained for up to six (6) months; records are kept as required by law.
13.5 Clients may request access, correction, or deletion of personal data unless retention is legally required.
13.6 Consent may be withdrawn prior to completion of testing, subject to applicable fees.
13.7 Use of Services constitutes acceptance of the Company’s Privacy Policy.
14. LIMITATION OF LIABILITY
The Company’s liability is strictly limited to the amount paid for the Service in question. We are not responsible for indirect, incidental, or consequential damages arising from the use of our Services.
15. GOVERNING LAW
These Terms are governed by the laws of the State of Louisiana. Any disputes shall be resolved exclusively in the courts of Louisiana.
